General terms and conditions

1. Identification of the provider

1.1. The Miosotis Healthy Life website (the “Site”) is operated by Carlos Baeta – Unipessoal, Lda (hereinafter “Miosotis Healthy Life”), a single-member private limited company with its registered office at Ribeira de Nisa, Portugal, with tax identification and registration number 515702072 at the Commercial Registry Office of Portalegre, and a share capital of 500 euros, which may be contacted by email at contact@miosotis.org or by telephone on +351 245 308 050. 
1.2. The use of the Miosotis life Website implies full and unreserved acceptance of the provisions included in these General Terms and Conditions, in the version in force, at each time you access the Website. The General Terms and Conditions may be changed without prior notice, but any changes will always be published on the Miosotis life website.
1.3. By consulting, using, or downloading the content of the Site, you are committing to respect the conditions established in the General Terms and Conditions of Miosotis life.
1.4. Miosotis life’s Website contains information that is freely accessible and can be consulted without having to register on the Website.
1.5. Each user is considered a final consumer. Consultation of the information contained on the Miosotis life website is for personal use and cannot be transferred or sold to third parties.

2. General

2.1. These Terms and Conditions of Use govern access to and use of the Site. 

2.2. By using the Site, the user accepts these Terms and Conditions of Use, in the version in force at the time of access, and undertakes to comply with them when viewing, using or downloading its content. 

2.3. The Site contains freely accessible information, which may be viewed without registration. 

2.4. Where the user is a consumer under Portuguese law, nothing in these Terms and Conditions of Use limits the mandatory rights conferred on them, in particular by Decree-Law No. 446/85 of 25 October (general contractual terms) and Law No. 24/96 of 31 July (Consumer Protection Act). 

3.Intellectual property

3.1. The content of the Site (including text, graphics, photographs, logos and other elements) is protected by copyright and other intellectual property rights belonging to Miosotis Healthy Life or to third parties who have authorised its use. 

3.2. The content of the Site may be viewed and used for personal, non-commercial purposes, but may not be transferred or sold to third parties. 

3.3. Commercial use of the content of the Site requires the prior written authorisation of Miosotis Healthy Life, which may be requested using the contact details set out in clause 1.1.

4. Liability

4.1. Each user is responsible for the content of the information they send through the Site. 

4.2. Miosotis Healthy Life implements appropriate technical and organisational security measures, but cannot guarantee the absolute security of communications over the Internet and is not liable for security breaches resulting from circumstances beyond its reasonable control. 

4.3. The Site may be subject to interruptions or other technical failures for reasons beyond the control of Miosotis Healthy Life. 

4.4. The Site may contain links to third-party websites or be accessed from them. Miosotis Healthy Life is not responsible for the content, policies or practices of those websites. 

4.5. Nothing in these Terms and Conditions of Use excludes or limits the liability of Miosotis Healthy Life for damage caused to the life, physical or moral integrity or health of any person, for damage resulting from wilful misconduct or gross negligence, or in any other case where such exclusion or limitation is prohibited by law, in particular by Article 18 of Decree-Law No. 446/85 of 25 October.

5. Personal data

5.1. The processing of personal data carried out through the Site is governed by the Privacy Policy, available via the Privacy Policy link in the Site’s footer, which is a separate document from these Terms and Conditions of Use. 

6. Changes

6.1. Miosotis Healthy Life may amend these Terms and Conditions of Use. Any changes are published on the Site, together with the date of the last update, and each use of the Site is governed by the version in force at the time of that use. Users are advised to review them periodically.

7. Governing law and dispute resolution

7.1. These Terms and Conditions of Use are governed by Portuguese law. 

7.2. If any provision is found to be unlawful, void or unenforceable, it shall be deleted or limited to the minimum extent necessary, without affecting the validity of the remaining provisions. 

7.3. In the event of a dispute, Miosotis Healthy Life and the user will seek an amicable solution within 30 days of receipt of the complaint. This attempt does not affect the user’s right to bring the matter before the courts or an alternative dispute resolution body at any time. 

7.4. Where the user is a consumer, the court of the user’s place of domicile, or any other court whose jurisdiction arises from a mandatory rule, shall have jurisdiction. For users who are not consumers, the court of the District of Portalegre shall have jurisdiction, with express waiver of any other, to the extent permitted by law.

8. Alternative consumer dispute resolution and Complaints Book

8.1. In the event of a consumer dispute, the consumer may refer the matter to the following alternative dispute resolution body, under Law No. 144/2015 of 8 September: CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (National Centre for Consumer Dispute Information and Arbitration) (www.cniacc.pt). 8.2. The consumer may also lodge a complaint through the Electronic Complaints Book (Livro de Reclamações Eletrónico), available at www.livroreclamacoes.pt.
